{"id":223870,"date":"2022-03-29T17:10:12","date_gmt":"2022-03-29T21:10:12","guid":{"rendered":"https:\/\/www.livabl.com\/articles\/?p=223870"},"modified":"2022-03-29T17:10:12","modified_gmt":"2022-03-29T21:10:12","slug":"b-c-introduces-cooling-off-period","status":"publish","type":"post","link":"https:\/\/www.livabl.com\/articles\/news\/b-c-introduces-cooling-off-period","title":{"rendered":"B.C. introduces amendments for cooling-off period to protect against challenging housing market"},"content":{"rendered":"<h4 id='pressboard-ad-sponsorship-tag' style='margin-bottom: 35px;'><\/h4><p><a href=\"https:\/\/www.livabl.com\/articles\/wp-content\/uploads\/2022\/03\/bc-cooling-off.jpg\" rel=\"lightbox[223870]\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-223873 size-full\" src=\"https:\/\/www.livabl.com\/articles\/wp-content\/uploads\/2022\/03\/bc-cooling-off.jpg\" alt=\"British Columbia has introduced a cooling-off period in order to protect home buyers.\" width=\"1800\" height=\"1200\" \/><\/a><em>Photo:\u00a0<a href=\"https:\/\/stock.adobe.com\/ca\/contributor\/206748504\/imagenet?load_type=author&amp;prev_url=detail\" class=\"external\" target=\"_blank\">Imagenet<\/a> \/ Adobe Stock<\/em><\/p>\n<p>British Columbia has introduced a cooling-off period in order to protect home buyers, but some are not keen on the decision to do so.<\/p>\n<p>On Monday, March 28th, the \u200b\u200bprovince\u2019s Ministry of Finance <a href=\"https:\/\/news.gov.bc.ca\/releases\/2022FIN0012-000424\" class=\"external\" target=\"_blank\">announced that amendments<\/a> had been introduced for the \u200b\u200bProperty Law Act to enable the creation of a new Homebuyer Protection Period, which is meant to \u201cprotect people buying a home in a challenging real estate market.\u201d<\/p>\n<p>The Homebuyer Protection Period \u2014 otherwise known as a \u201cright of rescission\u201d \u2014 would respond to the pressure of placing purchase offers on a home without basic conditions in a competitive marketplace. Under the new amendments, a time period would be granted to give buyers more time to consider their offers and complete conditions for financing and inspection. Seventy per cent of offers made in B.C\u2019s most competitive markets over the last year have been without conditions, according to the province.<\/p>\n\n<p>B.C. would be the first province in Canada to implement a homebuyer protection period for both resale properties and new construction homes. Seven-day cooling-off periods for multi-unit pre-construction units are already in place under the Real Estate Development and Marketing Act.<\/p>\n<p>Regulations would be introduced this year to determine the specific time period homebuyers will have to exercise the right of rescission, which will vary by region. The parameters of the legislation will be informed based on consultation by the BC Financial Services Authority (BCFSA) with real estate industry stakeholders. BCFSA\u2019s consultation analysis is expected this spring, and protection measures are anticipated to be in place by the summer.<\/p>\n<p>\u201cPeople need to have protection as they make one of the biggest financial decisions of their lives,\u201d said B.C Finance Minister Selina Robinson, in a press release.<\/p>\n<p>\u201cIn our overheated housing market, we have seen buyers feeling pressure to waive conditions just to be considered, and new homeowners discovering costly problems only after a deal has closed. We want to make sure people buying a home have time to get the information they need to make a sound decision within limits that still give sellers the certainty they need to close sales,\u201d she added.<\/p>\n<h3>Some don&#8217;t see cooling-off period as the solution<\/h3>\n<p>In response to Minister Robinson\u2019s announcement, Darlene K. Hyde, CEO of the B.C. Real Estate Association (BCREA), <a href=\"https:\/\/www.bcrea.bc.ca\/advocacy\/bcrea-addresses-minister-robinsons-announcement\/\" class=\"external\" target=\"_blank\">pointed out<\/a> that while governmental language has changed, the Homebuyer Protection Period is essentially the cooling-off period that has been discussed recently.<\/p>\n<p>Hyde acknowledged that realtors share the concerns of the government over consumer risks in heated markets, but stated that a cooling-off period could have \u201cunintended consequences.\u201d This could include encouraging buyers to make offers on properties that they&#8217;re not serious about, fueling prices and competition.<\/p>\n<p>BCREA stated that it supports the province\u2019s intent to introduce a Homebuyer Protection Period, but pointed out that the cooling-off period \u201cfails to meet the needs of British Columbians.\u201d In <a href=\"https:\/\/www.bcrea.bc.ca\/news-releases\/only-35-per-cent-of-british-columbians-support-governments-cooling-off-period-according-to-recent-polling\/\" class=\"external\" target=\"_blank\">a survey with<\/a> 1,157 B.C. residents, BCREA said 35 per cent of respondents supported the introduction of a cooling-off period, and 71 per cent stated that realtors should be consulted when developing and implementing policies that impact real estate markets.<\/p>\n<div class=\"see-more-link\"><img decoding=\"async\" alt=\"See Also\" src=\"https:\/\/www.livabl.com\/articles\/wp-content\/themes\/livabl\/images\/see-also-cta-icon.svg\"\/>\r\n          <strong><span>SEE ALSO:<\/span><a href=\"https:\/\/www.livabl.com\/articles\/2022\/03\/greater-vancouver-condo-launch-q1-2022.html\"  area-label=\"Greater Vancouver could see over 4,100 new construction condo units launch in Q1-2022\">Greater Vancouver could see over 4,100 new construction condo units launch in Q1-2022<\/a><\/strong>\r\n        <\/div>\n<p>In his <a href=\"https:\/\/www.livabl.com\/articles\/2022\/03\/greater-vancouver-track-barnburner-march.html\">monthly market report<\/a> for February, broker and chief economist at Dexter Realty, Kevin Skipworth, said that a cooling-off period may result in fewer listings and delays within the market.<\/p>\n<p>\u201cThe effect would be chaos, with a cascading effect. A seller would not know for a week or so whether the sale was actually going through. If it didn\u2019t, the next buyer would also have a mandatory grace period, and so on,\u201d he said.<\/p>\n<p>In February, BCREA published a white paper and a number of recommendations for the B.C. government on the housing market, which included alternatives to the cooling-off period, such as a five-day pre-offer period.<\/p>\n<p>&#8220;Policy should equally protect all parties involved in real estate transactions while also contributing to a smooth functioning market and improved housing affordability. But the Province&#8217;s plan to amend the Property Law Act to create a cooling-off period in real estate transactions leaves BC consumers with more questions than answers,&#8221; said
